Terms of Service – SiteWrite

These Terms of Service ("Terms") govern your use of SiteWrite, a website content planning platform available at sitewrite.com (the "Service"), operated by 90 Degree Design LLC ("SiteWrite," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use SiteWrite.

1. Who these terms apply to

Agency users create accounts and use SiteWrite to build content plans, manage projects, and invite clients to review work. These Terms apply directly to you.
Clients submit information through public intake forms or review pages without creating an account. By submitting information through those pages, you agree to the limited terms in Section 8 below.

2. The Service

SiteWrite helps agencies and developers generate AI-assisted website content plans and sitemaps, collect client input through no-login intake forms, and manage client review and feedback on a white-labeled basis.

We may add, change, or remove features over time. We'll try to give notice of significant changes that affect how you use the Service.

3. Accounts

You must provide accurate information when creating an account and keep your login credentials secure.
You're responsible for all activity that happens under your account.
You must be at least 18 years old to create an account.
Notify us right away if you suspect unauthorized access to your account.

4. Subscriptions and billing

SiteWrite offers a single paid plan, billed monthly, in addition to a free first plan with no card required.
The paywall applies when you start a second content plan; previously finished plans remain accessible even without an active subscription.
Payments are processed through Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel.
You can cancel your subscription at any time through your account settings. Cancellation stops future billing; we don't provide refunds for partial billing periods unless required by law.
We may change pricing with advance notice. Continued use after a price change takes effect means you accept the new pricing.

5. Acceptable use

You agree not to:

Use SiteWrite for any unlawful purpose or in violation of any applicable law
Use the Service to generate content that is defamatory, discriminatory, infringing, or intended to deceive
Attempt to reverse-engineer, scrape, or interfere with the Service's infrastructure
Circumvent usage limits, fair-use caps, or paywall restrictions
Impersonate another person or misrepresent your affiliation with any agency or client
Upload malicious code or attempt to compromise the security of the Service

We reserve the right to suspend or terminate accounts that violate these terms.

6. AI-generated content

SiteWrite uses AI to help generate content plans, sitemaps, and suggested copy. You understand and agree that:

AI-generated content may contain errors, inaccuracies, or content that requires review before use
You're responsible for reviewing, editing, and approving any content before publishing it to a live website
SiteWrite makes no guarantee that generated content is factually accurate, legally compliant, or free of third-party rights issues
You retain responsibility for how generated content is ultimately used

7. Ownership of content

Your content: you retain ownership of the project information, prompts, and content you input into SiteWrite, and of the content plans generated through your use of the Service.
Client submissions: information submitted by clients through intake and review forms belongs to the agency user who owns that project. SiteWrite does not claim ownership over this content and acts only as the platform through which it's collected and stored.
Our platform: SiteWrite's software, design, branding, and underlying technology remain our property. These Terms don't grant you any rights to our trademarks, logos, or platform code beyond what's needed to use the Service as intended.
License to us: you grant SiteWrite a limited license to store, process, and display your content as needed to operate the Service (including generating AI outputs and rendering white-labeled client pages).

8. Client intake and review pages

If you're a client submitting information through an intake form or review page invited by an agency:

You're providing that information to the agency, and SiteWrite processes it on their behalf
You don't need to create an account, and no password or login is required
Your submission is stored as part of that agency's project and is controlled by them
Questions about how your information is used should be directed to the agency who invited you

9. White-label branding

Agency users may upload their own logo and branding to be displayed on client-facing intake and review pages. You're responsible for having the rights to any branding assets you upload. SiteWrite is not responsible for verifying ownership of uploaded branding materials.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or fully secure.

11. Limitation of liability

To the maximum extent permitted by law, SiteWrite and its owners, employees, and affiliates won't be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including damages related to lost profits, lost data, or content generated through the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

12. Termination

You can stop using the Service and cancel your account at any time.
We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law.
Upon termination, your right to access the Service ends, though provisions of these Terms that reasonably should survive (like ownership, disclaimers, and limitation of liability) will continue to apply.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll notify agency users by email or through the Service. Continued use of SiteWrite after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, unless otherwise required by applicable law where you reside.
